  • Sec. 22-261. – Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Fence means any wall or structure more than 12 inches in height, erected or maintained for the purposes of enclosing, screening, restricting access to or decorating the surrounding lot, parcel, building or structures.

Subdivision fence means a fence located adjacent to a public right-of-way constructed of the same materials with substantially the same continuous design that has been installed as an architectural feature, screening device, or sound barrier across the front yard, rear yard and/or side yard of four or more adjacent lots, with breaks in the fence only at intersections with public rights-of-way, utility, drainage or pipeline easements, or creeks, streams, and/or other water ways.

  • Sec. 22-262. – Permit to construct required.

It shall be unlawful and an offense for any person to construct a fence in the city without first obtaining a permit as required by the building code of the city.

  • Sec. 22-263. – Height—Rear yard and alley line.

No fence shall be constructed at a height exceeding eight feet along the rear yard or alley line of any property within the city.

  • Sec. 22-264. – Same—Side yard.

No fence shall be constructed at a height exceeding eight feet on any side yard line between the front building line and the rear lot line on any property within the city.

  • Sec. 22-265. – Maintenance of subdivision fences.

(a) Subdivision fences must be maintained in accordance with this chapter and Chapter 56 of the Code of Ordinances.

(b) Whether or not one or more portions or segments of a subdivision fence are owned by more than one person and/or entity, a subdivision fence must be maintained uniform in appearance and construction for the entire length of the subdivision fence in accordance with subsection 22-272(a).

(c) If a subdivision fence is owned by more than one person and/or entity and the owners cannot agree on a uniform color for materials, including paint, if applicable, of the subdivision fence on or before the fifteenth day following delivery of written notice from the building official to select a color, the building official shall have the authority to select the required color of the subdivision fence materials or paint, whichever is applicable, in which case the subdivision fence shall be constructed in the color selected by the building official.

(d) If a subdivision fence is replaced in its entirety, the finished side of the fence must face the public right-of-way.

  • Sec. 22-266. – Side yards of corner lots.

On corner lots, where side yards are required adjacent to the street to conform to minimum front yard setback of lots fronting upon such street, within the same block and upon the same side, no fence shall be constructed or maintained within such required side yard.

  • Sec. 22-267. – Fences dangerous to traffic.

On any lot, no fence shall be constructed or maintained which constitutes a danger to traffic.

  • Sec. 22-268. – Variances.

Appeals to the conditions of this article shall be heard by the zoning board of adjustment. The zoning board of adjustment shall have the authority, upon appeal in specific cases, to authorize such variances from the terms of this article as will not be contrary to the public interest, where, owing to special conditions, a strict enforcement of the provisions of this article will result in unnecessary hardship, and so that the spirit of this article shall be observed and substantial justice done.

  • Sec. 22-269. – Electrified fences.

Electrically charged fences, whether battery, transformer, or any other type, shall not be installed or used within the corporate limits of the city.

  • Sec. 22-270. – Required as buffer elements.

Any fence which is required to serve as visual screening, a noise barrier or any other buffering purpose in any multifamily, office, retail, commercial or industrial district may exceed eight feet in height with city council approval of a site plan; provided, however, that such fence is approved by the city’s chief building official and, in the opinion of the building official, poses no threat to safety, is not a nuisance, and in no way violates any other pertinent city code, ordinance, section or provision.

  • Sec. 22-271. – Side and rear yard fence materials.

Fences along the rear yard line and the side yard line of any property from the front yard building setback line to the rear property line or rear easement line, within a residentially zoned area of the city, may be constructed of materials or products such as chainlink, wood planks and boards, masonry as defined by the building code, and wrought iron or ornamental iron. Materials or products such as rope; string; wire and wire products including, but not limited to, barbed wire, razor ribbon wire, chicken wire, wire fabric and welded wire fabrics; chain; netting; cut or broken glass; paper; corrugated metal panels; and plywood are prohibited. Other wood, metal or plastic products that are designed specifically for uses other than fence construction are also prohibited.

  • Sec. 22-272. – General fence provisions.

(a) Fences that are constructed on any property within the city must be of approved materials and must be of uniform construction throughout the fence. Once a pattern of materials and construction method is established, it must be carried throughout the entire length of fence section from corner post to corner post.

(b) It shall be unlawful to erect a fence which alters the natural drainage or planned drainage on any residential lot.

(c)  Used or secondhand materials shall not be used in the construction of any fence in a residential area.

(d) The exterior surface of all masonry fences, including concrete block materials, shall be free from projections, inequalities or unevenness of surface, ridges or hollows, and obstructions. The exterior surface of masonry fences in residential areas shall be finished with a stain, pigment, paint or other surface treatment or material that is consistent with other finishes existing on the primary structure existing on the property.

(e) All fence materials, construction, and workmanship shall comply with all requirements of the building code and all approved plans and specifications.
